场外衍生工具监管制度

2008年的全球金融危机突显了场外衍生工具市场的结构性不足。为应对有关问题，立法会于2014年3月26日颁布《2014年证券及期货(修订)条例》（《修订条例》）。《修订条例》订立香港场外衍生工具市场的监管框架。

《修订条例》正分阶段实施：

  • 第一阶段已于2015年7月10日生效，涉及某些掉期息率及不交收远期交易的强制性汇报，及相关备存纪录责任以及新制度整体框架;
  • 第二阶段涉及(i) 港元或四大工业货币（即美元、欧元、英镑或日圆）的某些标准化掉期息率交易的强制性结算及相关备存纪录责任，及为施行强制性结算的中央对手方的指定; 及(ii) 扩大强制性汇报，因而所有五个主要资产类别（即: 利率，外汇，股票，信贷和商品）的场外衍生工具会被涵盖。这分别已于2016年9月1日及2017年7月1日生效。
  • 该制度的其他环节将会在较后阶段实施。
