成交单据、户口结单及收据规则

问1 : 假如中介人没有再质押任何证券抵押品，该商号可否在客户结单内如是披露？

答:

并无任何特别规定要求中介人在客户结单上披露其没有再质押证券抵押品。

凡已获发牌进行证券交易或证券保证金融资的中介人，而：

  • 该中介人或该中介人的有联系实体在按月会计期内的任何时间曾持有证券抵押品；及
  • 在该按月会计期内的任何时间，该中介人或该中介人的有联系实体曾再质押该中介人的证券抵押品，则《成交单据规则》第11(3A)条即适用。

中介人如没有再质押客户证券抵押品，则不受《成交单据规则》第11(3A)条的规限。然而，拟在客户结单内作出任何陈述的商号，须确保在客户通讯文书中的所有声明均属准确无误。

问2 : 根据第11(3A)条的规定于客户月结单内所作出的披露，有否任何标准用语？

答:

没有。第11(3A)条载列须在客户月结单内向保证金客户披露的资料，但没有提供特定用语。

问3 : 《成交单据规则》第11(3A)条的披露规定是否适用于现金客户的月结单？

答:

只有当中介人或该中介人的有联系实体在某按月会计期内的任何时间曾就客户户口持有证券抵押品，《成交单据规则》第11(3A)条的规定才会适用于该等客户户口。一般而言，现金客户的证券仅交由经纪存管，及并非证券抵押品。因此，上述规定并不适用于现金客户的月结单。

问4 : 如适用于本条文的中介人已再质押客户的证券抵押品，但却没有动用藉抵押该等抵押品而取得的信贷融通，该商号是否仍须在客户月结单内作出披露？

是。不论中介人是否已动用藉再质押客户证券抵押品而取得的信贷融通，本条文一概适用。
